Acceptable Use Policy

What you may not do with our software, and what happens if you do it anyway.

Version
1.0
Effective

Applies to
Native Code LLC

The whole policy in one lineDo not break the law, do not hurt people, and do not attack the service. Everything below is detail on those three.

Section 1Who this applies to

This policy is part of the Terms of Service and the End User License Agreement. It applies to everyone using anything we make: our websites, our applications, our APIs, and software we host for a business customer.

If you give other people access to an account you control, you are responsible for what they do with it.

Section 2Nothing illegal

Do not use our software to do, plan or assist anything unlawful. That includes:

  • fraud, deception for financial gain, or laundering money;
  • infringing somebody else’s copyright, trademark, patent or trade secret;
  • breaching export control or sanctions law;
  • distributing controlled substances, weapons, or anything else whose sale is restricted where you are;
  • evading a court order, a regulator, or a sanctions list.

Section 3Nothing that harms people

  • No harassment, stalking, threats or targeted abuse of a person.
  • No sexual content involving children, in any form. We report this to the authorities and terminate the account immediately, with no warning and no appeal.
  • No content that promotes violence, or that attacks people on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity or sexual orientation.
  • No impersonating a person or an organization in a way designed to deceive.
  • No collecting or publishing somebody’s personal information without a lawful basis, and no doxxing.
  • No using our software to monitor a person who has not been told they are being monitored, where the law requires them to be told.

Section 4Nothing that attacks the service

  • Do not attempt to gain access to an account, a system or data that is not yours.
  • Do not probe, scan or test the security of our systems except within the rules on the Security page.
  • Do not interfere with, overload or degrade the service, or attempt a denial of service.
  • Do not bypass a rate limit, a paywall, an access control or a usage cap.
  • Do not upload malware, or use our software to distribute it.
  • Do not reverse engineer our software, except where your local law expressly permits it.
  • Do not scrape our services at a volume that affects other users, and do not present automated access as a person.

Section 5Rules for anything that sends messages

Some of our software sends email or notifications on your behalf. That capability comes with conditions, because abusing it damages deliverability for everyone using the same infrastructure.

  • Only send to people who have agreed to hear from you. A list you bought is not consent, and neither is a business card in a bowl.
  • Every marketing message must include a working way to unsubscribe, and an unsubscribe must be honoured promptly.
  • Do not forge a sender address or mislead about who a message is from.
  • Follow the law that applies to you, including the CAN-SPAM Act, the Telephone Consumer Protection Act, GDPR and equivalent rules elsewhere.
  • Keep your complaint rate low. Sustained spam complaints will get the feature switched off for your account.

Section 6Content you put into our software

Your content is yours and we do not go looking through it. We do not proactively monitor what customers store, and we do not want to.

What we will do is act on a credible report, and act on something we cannot ignore if it surfaces while we are fixing a fault you reported. You are responsible for having the right to store and process whatever you put in, including any personal information about other people.

Section 7Fair use of shared resources

Where a plan is described as unlimited, it means we have not set a number, not that no number exists. Use that reasonably relative to what the product is for. If your usage is an outlier that affects other customers, we will contact you and work out a plan that fits before we do anything else.

We will not silently throttle you and leave you to figure out why the software got slow.

Section 8What we do when this is broken

Our response is proportionate to what happened.

  1. We tell you what the problem is and give you a reasonable chance to fix it. This is where most cases end.
  2. We limit the feature being abused, rather than the whole account, where that is enough.
  3. We suspend the account if the problem continues or the risk is immediate.
  4. We terminate for serious or repeated breaches, and refund the unused part of any prepaid period unless the breach involved fraud or abuse.
  5. We report it to law enforcement where the law requires it or the harm is serious enough.

For child sexual abuse material, credible threats to life and active attacks on our systems, we skip straight to termination. There is no warning step for those.

If you think we got it wrong, tell us through the contact form. A person will look at it again.

Section 9Reporting abuse

If somebody is using our software to do something on this page, tell us through the contact form with as much detail as you can give. We answer within one business day, and faster when the report involves an immediate risk to somebody.

Copyright complaints have their own route, on the Copyright and DMCA page.
